These terms apply to your use of this store and to any order placed with Resilience Agenda Australia Pty Ltd, trading as Resilience Agenda or Mental Fitness Daily.
Placing an order
Your order is an offer to buy or pre-order. The contract is formed when we send you a dispatch confirmation. If we cannot fulfil your order we will tell you and refund you in full.
Language and record
Contracts can be concluded in English. We do not file a copy of the contract text separately, so please keep your order confirmation email. Before you pay, the checkout shows your basket, prices, delivery cost and delivery address, and lets you correct input errors by returning to the previous step.
Pricing, currency and tax
Prices are shown in the currency selected for your market. Whether tax is included depends on your destination and is stated in the Shipping Policy and shown at checkout.
If an item is listed at an obviously incorrect price we may cancel and refund rather than fulfil.
Payment
We accept the payment methods shown at checkout. Payment is taken at the time of order, including for pre-orders.
Pre-orders
Pre-order items are charged at order and dispatched when stock arrives. The expected dispatch date is shown on the product page. If it moves by more than 14 days we will email you and you may cancel for a full refund.
Our intellectual property
The Resilience Agenda brand, Mental Fitness methodology, the Mental Fitness Toolkit and its ten named tools, the Resilience Agenda and Mental Fitness Daily names and logos, and all text, design, photography and course material are our property or licensed to us.
You may not reproduce, distribute, adapt, teach from or sell our material, or use it to deliver training or coaching of your own, without written permission. Buying a diary, a course or a book grants you a personal licence to use it, not a licence to reproduce or teach it.

Online courses
Access is for one person. You may not share logins, record sessions or distribute materials. Where access is described as ongoing, we will give at least 90 days' notice before withdrawing a course and will make materials downloadable during that period.
Our content is educational, not clinical
Resilience Agenda produces Mental Fitness training material. It is educational and preventative in nature. It is not therapy, diagnosis, or medical or psychological treatment, and it is not a substitute for care from a qualified professional.
If you are experiencing mental ill-health, please speak to your doctor or a registered practitioner. If you are in crisis, contact your local emergency services. In Australia, help is available on 000. In the United States, 911. In the UK and Ireland, Samaritans are available free on 116 123. Across the European Union, 116 123 also reaches an emergency emotional support line in most member states. In Switzerland, Die Dargebotene Hand is on 143.
Acceptable use
Do not interfere with the store, scrape it, resell our products commercially without authorisation, or submit false information at checkout.
Reviews and submissions
If you send us a review, photograph or testimonial you grant us a non-exclusive licence to use it in our marketing. You can ask us to stop at any time.
Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Nothing limits your statutory rights as a consumer.
Subject to that, our liability for any claim relating to a product or your use of this store is limited to replacing the product or refunding the price paid. We are not liable for indirect or consequential loss, or for loss of profit or business where you are not a consumer.
Governing law
These terms are governed by the law of Victoria and Australia.
Dispute resolution
Please email letstalk@resilienceagenda.com first. Most things are resolved that way.
We are not obliged to participate in, and do not participate in, alternative dispute resolution before a consumer arbitration board. If you wish to pursue a dispute outside the courts, the European Commission maintains a list of national dispute resolution bodies at consumer-redress.ec.europa.eu.
